Introduction

Welcome to Fourbs Group Pty. Ltd.'s Standard Terms and Conditions. This document provides a comprehensive outline of the general terms governing our services. These terms apply to all projects undertaken by Fourbs Group Pty. Ltd. and are intended to supplement any specific agreements or contracts. 1. Acceptance of Terms

1.1 Acceptance Procedure

Clients may accept a quotation through various legally recognized mediums including digital acceptance via Xero, oral communication, electronic mail, or SMS. Acceptance indicates the client's agreement to adhere to these terms and conditions.

Please note that by accepting these terms, you also acknowledge and agree to our Privacy Policy, which outlines how we handle and protect your personal information.

1.2 Scope of Agreement

Upon acceptance, the terms outlined herein, along with any specific contract terms, constitute a binding agreement between Fourbs Group Pty. Ltd. and the client.


2. Financial Terms

2.1 Deposit Requirements

For projects involving materials exceeding AUD $2,000 in value, a deposit equal to the full cost of these materials is required prior to commencement of services, unless otherwise agreed in writing.

2.2 Payment Terms

Payment is due immediately upon completion of services and receipt of invoice, except when an alternative payment arrangement is agreed upon in writing.


3. Price Matching

Fourbs Group Pty. Ltd. aims to offer competitive pricing. A bona fide written quotation for an identical scope of work and materials will be matched by us. Quotations with different materials are subject to our ability to obtain equivalent materials.


4. Cancellation Policy

Cancellations post-quotation acceptance but prior to service commencement incur a 25% fee of the total materials cost. This fee covers restocking, supplier, and administrative expenses.


5. Force Majeure

5.1 Definition

"Force Majeure" refers to unforeseeable events beyond Fourbs Group's control that impede our ability to fulfill contractual obligations.

5.2 Suspension of Obligations

Our obligations are suspended for the duration of the Force Majeure event.

5.3 Termination Clause

If Force Majeure continues beyond 60 days, either party may terminate the agreement.


6. Liability and Insurance Coverage

Fourbs Group Pty. Ltd. holds Professional Indemnity Insurance and Public and Products Liability Insurance within specified coverage limits. Our liability is constrained by these insurance coverages.


7. Dispute Resolution

7.1 Initial Resolution Efforts

Disputes should first be addressed through mutual discussions between Fourbs Group Pty. Ltd. and the client.

7.2 Mediation and Arbitration

If unresolved, mediation, followed by arbitration under the ACICA rules, shall be pursued.

7.3 Governing Law

These terms and any dispute arising from them are governed by the laws of New South Wales.


8. Changes to This Policy

Fourbs Group Pty. Ltd. may revise these terms and conditions at any time. Updated versions will be posted with their effective date.


9. Workmanship Warranty
